No jurors chosen Tuesday for Komisarjevsky trial

Attorneys still waiting for hearing on motion to give Komisarjevsky life without parole

Prospective jurors were questioned but none were picked for the second Cheshire home invasion murder trial on the fourth day of jury selection Tuesday.

Prosecutors and defense lawyers questioned six individuals, but all six were excused for cause.

About 70 people reported for jury duty Tuesday morning, but only three were called for voir dire, where the prosecution and defense attorneys question prospective jurors as to their suitability to serve.

By noon the remainig perspective jurors were dismissed. A court clerk said that jurors held over from Monday were to be questioned Tuesday afternoon.

Joshua Komisarjevsky, 30, faces 17 counts for the 2007 kidnapping and robbery that ended in the murders of a Cheshire mother and her two daughters.

The charges include capital felony murder, which carries the death penalty.

A co-defendant, Steven Hayes, 47, was convicted on the same charges in 2010 and sentenced to death row.

Tuesday’s court proceedings in New Haven Superior Court were also uneventful concerning a defense motion to sentence Komisarjevsky to life in prison without possibility of release, instead of the death penalty.

Judge Jon C. Blue said the motion would be heard by another judge, but there was no word Tuesday that it had been assigned or scheduled.

Komisarjevsky’s trial is scheduled to start Sept. 19. The first phase to decide his guilt or innocence is expected to take about a month.

Judge Blue said if he is convicted there would be a second phase to determine his punishment, which could take about two months.
